Amy Coney Barretts Fitness for the Supreme Court: In Vitro Fertilization and American Consumerism – National Catholic Register
Amy Coney Barrett is a danger to families who desperately want children. So says Sen. Tammy Duckworth, D-Ill., based on an advertisement which Barrett signed back in 2006, which included the statement that we defend the right to life from fertilization to natural death. This, Duckworth suggests, disqualifies Barrett from the U.S. Supreme Court.
Duckworth, who has two daughters through IVF, told Fox News: If a fertilized egg in a person is a person, then that really has significant negative consequences for a family like mine that desperately wanted to have children.
I dont know Judge Barrett from Adam. But I do know something about infertility and the IVF industry. The IVF industry appeals to the worst instincts of American consumerism. The Catholic critique of artificial reproductive technologies is morally defensible.
Get what you want, the way you want it, when you want it. Sounds like a fine idea. Pick the one you want. Pay for it. Ignore all the others. Or just throw away anything you are tired of or dont want, or that doesnt satisfy you. Or you could turn it in for a refund. Or maybe you could buy a few extras to keep on hand just in case you want more. You can always throw them away later. Or maybe donate them to a charity.
Have it your way, is a fine advertising slogan for hamburgers. Take advantage of quantity discounts and stock up just in case, is a fine strategy for buying paper towels. But the object in question when considering artificial reproductive technologies is not an object at all, but a person. I buy the sperm or egg of a stranger. I pay someone to mix their gametes with mine. I look at the embryos. With the help of an expert with exquisite taste, I choose the ones I want. I throw away the rest. Or, maybe, I put them in cold storage, just in case I decide I want them later.
This is the assisted reproductive technology industry, including IVF, surrogacy and related technologies. Consumers of this product are sometimes called commissioning parents. The fact that people want the product is supposed to be a sufficient moral justification to allow them to have what they want.
Two points for the record: First, we must never regret the existence of a particular child, no matter how that child was conceived. Disapproval of the circumstances of a persons conception does not translate into a belief that the person so conceived is unworthy or defective. Presumably, everyone opposes rape as an immoral act. But a child conceived in rape is still a full member of the human race, fully deserving of respect, love and legal protection. Likewise, the child conceived through artificial means is fully human, fully deserving of respect, love and legal protection.
Second, do not try to dismiss my arguments with the assertion that I dont know the pain of infertility. As a matter of fact, I do. My husband and I dealt with infertility for four painful years. We can attest that it is a miserable experience. What we deny is that the depth of our misery or the intensity of our desire for a child is relevant to the question at hand.
Duckworth herself raised one of the crucial questions. Without seeming to realize the significance of her statement, she told Fox News:
In my case, with both of my girls, they looked at two or three fertilized eggs, not even embryos at this point, and said, you know, this one isnt very viable, Duckworth explained. The third discarded could result in my doctor being criminalized.
Duckworth added: If a fertilized egg in a person is a person, then that really has significant negative consequences for a family like mine that desperately wanted to have children.
What exactly is the third discarded thing? Duckworth says these zygotes are not even embryos at this point. Does she deny that the zygote is alive? How can a non-living thing be viable or not very viable? The terms zygote, embryo, and fetus describe stages of biological human development, not the development into a human person.
This is the first of the contradictions of this position. If the zygote is chosen, it is Duckworths precious child. If it is discarded, does that mean it never was anything or anyone of value?
Here is a related ethical dilemma. Suppose they dont want to discard the embryo, but they dont want to gestate her right away, either. So they freeze her. Later, they unfreeze her, gestate her, and then she becomes their precious child. What was this person during the time that she was frozen? An object? A nonperson?
Now you may think that I am causing problems here, because I referred to the frozen embryo as a person. You blurred the distinction between the zygote and the embryo and the ultimate person. If we would just all get on board with the proper terminology and proper thought process, that all these problems would go away.
But honestly, it doesnt have to be me who raises this question. What if one of the living children herself brings up these topics? Hey Mom and Dad, what about all my frozen siblings? Did you guys really kill a couple of my siblings on the very day that you chose me to live? I could have been the one that got frozen or killed. And so on.
Will you have answers for these questions? Will your answers be good enough for her? For that matter, will your answers be good enough for you and for your childs other parent as the years go by?
I have known people who have been in agony for years over their frozen children. I know an adult man whose mother revealed that she had an abortion when he was a teenager. The survivors guilt and disorientation he experienced were surreal. These questions will not all go away, just because no one is asking them right now.
Questions of this kind flow directly from the initial proposition that children are best viewed as the objects of their parents will. If the parents want the child, the child has legally recognized rights. If the parents do not want the child, they can do anything they want, at least before birth, and possibly beyond.
The most coherent alternative moral position is each child is an unrepeatable gift from a loving God. God created this particular child to reflect his goodness in some unique way. Our participation in the procreative process is to love our childs other parent and allow God to bless that love as he deems best for all of us. As parents, we accept the children God gives us and care for each of them to the best of our ability. If God does not give us children, we accept this fact with grace and move on with our lives.
As I say, I do not know Judge Amy Coney Barrett or what she believes. But I do know this: the IVF industry is indefensible. The Catholic alternative is both intellectually coherent and morally defensible. And I am not ashamed to say so.

Fitness Studios Are Trying to Pivot to Stay Open During the Pandemic – Washingtonian
An open-air, socially distanced class at the new Ascend Garage in Del Ray. Photograph courtesy of Ascend Cycle + Strength.
Last year was a very good one for Alyson Shade. The 36-year-olds Capitol Hill yoga spot, Realignment Studio, was doing great: It had a consistent base of returning clients, hosted its first teacher training program, and brought in revenue of almost $400,000, which Shade says is well beyond what similar studios usually earn in a year.
We were looking forward to 2020 being similar, and we were on track to continue that way, says Shade. Until obviously March changed a lot of things for us.
By March, Shade means the Covid-19 national emergency and Mayor Muriel Bowsers stay-at-home order. Suddenly, what was once a bustling studio was now a closed studio as Shade was forced to stream all her classes online. She managed to stay afloat for a while via virtual classes and a PPP loan, but it wasnt enough. By the middle of the summer, the studio had lost almost half of its expected revenue, says Shade, and in September, she decided to close the studio permanently.
Its a situation thats played out across the country as fitness owners try to find a way to reclaim the income they made in a pre-pandemic world. Virtual classes dont provide the same in-person experience and motivation, making it hard to retain customers, but many people dont feel comfortable going back to small, enclosed rooms to pant and sweat alongside strangers. Its also hard for smaller spots to compete with virtual-at-home behemoths like Peloton or Mirror, which have made bank during the pandemic.
Timothy Torres found this to be the case at the U Street barre-and-cycle spot the Dailey Method, of which hes a franchise owner. There was too much competition in the virtual space, so Torres stopped offering online classes after a while. And even though DC gyms could technically reopen under Junes phase two guidelines, the capacity limits were such that Torres could only have four clients in a room that used to fit 25. The cost to host in-person classes wasnt worth it, and Torres has decided to permanently close the once-healthy business on November 1.
Its a decision he blames partly on the governments pandemic response. Because the business was a franchise of a national brand, Torres wasnt eligible for DCs small business loans. And he believes the reopening guidelines were too strict. It felt like the government, especially the local government, didnt allow us to succeed, says Torres. It almost forced us to fail.
So, what does it take for a fitness group to survive the pandemic?
If you ask Chris Perrin of the bootcamp studio Cut Seven, its innovation, flexibility, and a swift response. When the group temporarily closed its Rhode Island Avenue location in March, it switched to an online platform. But Perrin quickly realized that people were hungry for in-person experiences. So the team started hosting outdoor bootcamps at Garrison Elementarys field, which provided enough room for everyone to socially distance. The workouts were such a success that Cut Seven recently opened an indoor-outdoor location in an old mechanics garage off 14th Street.
We are definitely going hard one way, says Perrin of going all-in on the outdoor model. But I think its the right way. I think people want something like this.
Because the group can store equipment in the garage at night, the open-air space feels more like a typical studio experience with kettle bells and benchesjust outdoors. While the group can only safely host half the number of clients they normally would, Perrin thinks itll be enough to sustain them through the pandemic.
And, like many DC-area restaurants, the group is planning to heat the outdoor space this winter so customers looking for a safe option will still come out on frigid days.
I am more confident in our ability to roll with the punches, says Perrin of upending his entire business model in seven months. I feel like this is the status quo. I think things can, and probably will, change again.
Its a bet Kat Zajac is making, too. The owner of Ascend Cycle + Strength was hosting virtual workout classes for a while, but found that it was difficult for her small group to have the resources and technology to stay competitive.
So when her landlord mentioned an empty garage down the street from her Del Ray location, Zajac decided to take a leap. The open-air Ascend Garage opened in July, with bikes spaced 10 feet apart and riders listening to the instructor and music via headphones, a la silent disco. The model has gone well: The classes are consistently full, and while Zajac says she was at 30 percent of her normal monthly income at the pandemics beginning, shes now inched up to 50 percent, even with limited capacity.
Like Perrin, Zajacs decided to embrace the outdoor concept: Shes leaving her lease at her original indoor spot down the road and is expanding the garage to include space for strength training classes. People are getting used to their own personal space, she says. Im not sure once a vaccine is here, or when the pandemic is more under control, that people will be wanting to snuggle up to each other and sweat.
Kendra Blackett-Dibinga has also pivoted her business model during the pandemic, but in more of a community sense. The owner of Bikram Yoga Works recently launched a campaign in the wake of protests over the killing of George Floyd, and has started hosting virtual town halls about the racial justice movement.
Were seeing ourselves transform into more of a community space, as opposed to just a yoga studio, says Blackett-Dibinga, who is offering both virtual and socially distanced classes. [Clients see it as] a place to take a pause and have insightful discussion and connect with people on a different level.
The studios campaign is called I Come to Breathe, and was inspired after Blackett-Dibinga took her daughters to a Black Lives Matter protest. I was looking at these people who are in the protests themselves, who were in the fight, and Im like, well, are they taking time for self-care?, she says. We need to be able to be of sound mind and body to continue to fight for justice.
The campaign has a series of ambassadors who share free classes with their communities, emphasize self-care as a form of resistance, and elevate voices not typically heard in the often homogenous fitness world. Of course, its a platform for inclusivity and discussions around social and racial justice, but its also a way to remind folks of the importance of these wellness spaces that are taking a hit. Its an intentional messaging coming from our business that was impacted by the closures, says Blackett-Dibinga. We want to remind people that even if you cant come into the studio environment, it doesnt mean everything has to come to a standstill.
Despite all this planning, these business owners know that its impossible to predict whats to come. There is one thing theyre certain of, though: They need to be ready to constantly reinvent themselves in order to financially survive the pandemic.
Its a rude awakening when we do start to feel comfortable, says Perrin of seeing other businesses close. [There are] so many reminders out here right now to make you feel uncomfortable and put you back in your work mode.
Zajac agrees. Its not an easy industry to be in, she says. And thats especially true now. You always have to be on your toes.

Raheem Sterling fitness update provided following withdrawal from international duty – Sports Illustrated
Manchester City forward Raheem Sterling is 'likely' to be fit for the club's Premier League clash against Arsenal on Saturday afternoon, according to Jamie Jackson of the Guardian.
The 25-year-old pulled out of England international duty earlier in the week after a minor hamstring problems arose during City's 1-1 draw with Leeds United at Elland Road.
After missing three international games for England, the winger is reportedly 'likely' to be fit enough to feature when Mikel Arteta's Arsenal travel to the Etihad Stadium - providing Pep Guardiola with a much-needed injury boost following a torrid time in the medical department at the start of the new campaign.
The news comes after Kevin De Bruyne had been all-but ruled out of the weekend's Premier League clash due to a muscle injury of his own, sustained during Belgium's 2-1 defeat to England at Wembley. Sergio Aguero could make some form of return on Saturday afternoon, as he returned to full first-team training on Monday of last week - however any involvement will likely be minor and come from the bench.

Democrats Zero In on Presidents Fitness for Office as Election Looms – The New York Times
WASHINGTON Speaker Nancy Pelosi, amplifying questions about President Trumps fitness for office less than a month before the election, introduced legislation on Friday that would create a standing bipartisan group of outside experts tasked with evaluating the presidents mental and physical health and advising Congress on whether the commander in chiefs powers should be forcibly removed under the 25th Amendment.
The measure is certain to die at the end of the year, given that it would need a presidential signature to be enacted. But Democrats decision to promote it now after the presidents coronavirus diagnosis and as Ms. Pelosi has suggested that his treatment might be affecting his judgment was an unmistakable dig at the sitting presidents capacity to govern, just weeks before voters go to the polls.
A presidents fitness for office must be determined by science and facts, Ms. Pelosi said at a news conference on Capitol Hill, where she insisted that the bill, a version of which was introduced before Mr. Trump was hospitalized with the virus, had nothing to do with him. This legislation applies to future presidents, but we are reminded of the necessity of action by the health of the current president.
The measure, sponsored by Representative Jamie Raskin, Democrat of Maryland, would create a bipartisan commission of health experts, doctors and former senior executive branch officials, such as a former president, selected by top congressional leaders, to report to Congress on the presidents competence.
Mr. Trump has raged against the idea, calling Ms. Pelosi Crazy Nancy and accusing her of staging a coup, and on Friday suggested that Democrats had proposed the measure because they were concerned not about his competence, but about that of former Vice President Joseph R. Biden Jr., his Democratic rival.
Crazy Nancy Pelosi is looking at the 25th Amendment in order to replace Joe Biden with Kamala Harris, Mr. Trump said on Twitter. The Dems want that to happen fast because Sleepy Joe is out of it!!!
Republicans blasted the legislation as an attempt to overturn the results of the 2016 election.
Right here in this last three weeks before the election, I think those kinds of wild comments should be largely discounted, Senator Mitch McConnell, the majority leader, told reporters in his home state of Kentucky.
Congress has never invoked the 25th Amendment to assemble a group like the one being proposed. The amendment was ratified in 1967, in the wake of President John F. Kennedys assassination, to prepare the country for an immediate transfer of power because of an emergency or illness. It directs the vice president to work with a commission to determine whether the president is unable to discharge the powers and duties of his office, and could forcibly transfer those powers to the vice president until the president recovered.
Mr. Raskin argued on Friday that the saliency of convening such a commission had been underscored by the pandemic, and said that he wished Congress had set up the panel when the amendment was first ratified, adding, there is never really a good time to do it because its always just seen in its local circumstance.
In the age of Covid-19, which has killed more than 210,000 Americans and now ravaged the White House staff, the wisdom of the 25th Amendment is clear, Mr. Raskin said. What happens if a president any president ends up in a coma, or on a ventilator, and has made no provisions for the temporary transfer of power?
The renewed focus around the measure comes as Mr. Trump continues to refuse to answer basic questions about his illness, including when he last tested negative for the virus. Mr. Trump returned to the White House on Monday evening after being hospitalized at Walter Reed National Military Medical Center, where he received two experimental drug treatments and was briefly put on supplemental oxygen.
Ms. Pelosi wondered aloud on a private conference call with House Democrats this week whether the steroids Mr. Trump was taking had an impact on his thinking, according to people on the call who spoke on the condition of anonymity to describe it.
He was to receive a televised medical evaluation Friday evening on Tucker Carlsons program on Fox News, conducted by a doctor who suggested in 2016, without evidence and without conducting a personal exam, that Hillary Clinton might be suffering from the lingering effects of a concussion that could compromise her fitness to serve.

Flexx Fitness Hawaii becomes first outdoor gym in the state – KHON2
Honolulu (KHON2) Flexx Fitness Hawaii opened its courtyard to offer gym go-ers a place to workout, in respect to CDC guidelines.
Since opening its doors a month ago, Flexx Fitness Hawaii has now become Hawaiis only outdoorfitness facility, motivating people to stay healthy in light of everything going on.
We opened our doors about a month ago, after the first shutdown, but since the second shutdown happened, we decided to move everything outside, now we have all our gym equipment in the Dole Cannery Courtyard, says Debbie Faildo, co-owner of Flexx Fitness Hawaii.
For those being out of the gym for the past few months, Faildo feels that getting back into a healthy lifestyle could be a challenge.
Faildo says, Whether you are new to the gym or you have been working out for years, we welcome everyone to Flexx Fitness Hawaii. We even offer personal training if you feel like you need a good jump start.
With the stay-at-home order in place, Flexx Fitness Hawaii has become a sanctuary for everyone to de-stress physically and mentally, something Faildo highly recommends.
The gym is a place for people to come and workout, but if anything, a place to help with your mental health. I cant tell you the amount of people that came up to me, and told me how depressed they were, since gyms have been closed, says Faildo.
Flexx Fitness Hawaii is now open for business with all employees and members respecting the CDC guidelines.

Goleta Playgrounds, Skate Park, Fitness Stations Are Open, But Be Careful Out There – Noozhawk
October 9, 2020 | 3:25 p.m.
The city of Goleta has announced the re-opening of our playgrounds, skate park, and fitness stations to the community as of Friday, Oct. 9, after being closed due to the COVID-19 pandemic.
Now that Santa Barbara County has moved into the Red Tier in the states Blueprint for a Safer Economy, Goleta can reopen these facilities in accordance with new guidelines (see below).
We know the community has been eagerly awaiting the reopening of the citys many great playgrounds, beloved skate park, and outdoor fitness stations," said Goleta Mayor Paula Perotte. It has been a long six months without public access to these facilities, and we appreciate your patience.
We encourage our community members to abide by the rules so that we can keep them open for our residents to enjoy.
Park facility guidelines:
Park facilities (playgrounds, skate park, fitness stations) are open during regular park hours: sunrise to sunset, seven days a week.Everyone two years old and older must wear a face covering that goes over their mouth and nose.Maintain physical distance of six feet between individuals from different households and prevent crowding of children.
Do not use the playground, skate park, or fitness stations when different households are unable to maintain a physical distance of six feet on play structures, swings, and other playground equipment.
No food or drink permitted on the playground, skate park, or fitness stations.Wash or sanitize your hands before and after your visit.Visit a playground at different times or days to avoid crowds and waits (peak hours tend to be weekday afternoons and weekends, 10 a.m.-4 p.m.).
To avoid crowding and allow everyone to use this space, please limit visits to 30 minutes when others are waiting.
Elderly individuals and people with underlying medical conditions should avoid playgrounds when others are present.Organized group activities that include people outside of your household are not permitted and should not use the playground.Users of the skate park at Jonny D. Wallis Neighborhood Park must comply with all of the new guidelines and the safety guidelines that were in affect prior to COVID-19, which include wearing a helmet and safety pads.
Playgrounds will not be staffed, so the city is relying on the community to abide by the guidelines above.
Safety is important. Playgrounds will be cleaned three times per week. Since it is not possible to clean all playground surfaces between every user, make sure every member of your group washes their hands or uses hand sanitizer before and after each playground visit.
In addition to bringing face coverings with you, it is a good idea to bring hand sanitizer and/or disinfecting wipes.
