Last Wednesday, a Seattle City Council committee voted 5-2 in favor of a proposal to tax sugar-sweetened beveragesaka a soda taxafter a flurry of amendments. The final legislative package is expected to be voted on today.

What the Legislation Does
The proposal, as it currently stands, would tax distributors of sugar sweetened beverages at a rate of 1.75 cents per fluid ounce, while exempting small manufacturers and distributors by charging them a lower rate of one-cent-per-ounce. Diet drinks would be exempted. Council staff estimate that the proposal will generate just under $15 million annually, revenue that would be directed towards nutrition education programs in minority and low-income communities, the citys childhood development program Birth to Five, and the 13th Year Scholarship. Additionally, in response to concerns from labor unions that the tax will result in job losses in the soda and beverage industry, the new legislation includes a $1.5 million funding allocation from the first few years of the tax for job placement and retraining for laid off beverage industry workers.
How the Legislation Has Evolved
The tax has gone through a sequence of revisions since Mayor Ed Murray first announced the proposal back in February of this year.
First his proposal was two cents per fluid ounce. Then, in late April, Murray announced that his office was amending the tax to include diet beverages to widen the tax baseand take into account the fact that diet sodas are consumed at higher rates by whites and affluent individualsand reduce the tax rate to 1.75 cents per fluid ounce.
More changes came to the legislation during its final hearing in the Affordable Housing, Neighborhoods, and Finance Committee. First, taxes on diet drinks were removed, over concerns that it would ruin the very incentive against sugar the tax was designed to create.
Council also threw a bone to some local businesses.
Councilmember M. Lorena Gonzalez introduced an amendment to bring down the tax rate for sugar sweetened beverage distributors that earn between $2 million and $5 million annuallyRachels Ginger Beer was the cited exampleto appreciate the razor-thin financial margins faced by small businesses and to incentive small business growth (the legislation wholly exempts businesses who earn less than $2 million annually). Councilmembers Mike OBrien and socialist Kshama Sawant squirmed at the prospect of taxing beverages marketed to higher income consumers at a lower rate than their low-income equivalents, and voted against the amendment (which sailed through anyways with approval from the rest of the present councilmembers).
Ultimately Councilmembers Sally Bagshaw, Gonzalez, Burgess, OBrien voted in favor of the tax, while councilmembers Herbold and Sawant dissented. Councilmembers Bruce Harrell and Debra Juarez were absent for the vote; however, given the five votes in favor already, the tax is expected to pass Monday.
Where Special Interests Stand
Outside of City Hall, the proposal is one that pits a variety of constituencies against each other (and formulates non-traditional alliances). Labor has sided with business interests, such as small business owners, the Seattle Metropolitan Chamber of Commerce, and the American Beverage Association in condemning the tax arguing that it will kill jobs in the beverage industry. Back in early April, a group of 150 small businesses in Seattle called on Murray to back off the tax for similar reasons, under the broad banner of Keep Seattle Livable For All, a coalition of said businesses partially organized and funded by the American Beverage Association. (The American Beverage Association has lobbied vigorously against soda tax initiatives in other cities and has spent millions to halt public health policies aimed at reducing Americans soda intake.)
The day after the council committee approved the tax package, the King County Labor Council and the Chamber put out a joint statement condemning the tax as a job-killer and called on the council to shelve plans to impose a tax on sweetened beverages that will wreak economic harm on small businesses and working families alike.
One the other side, Public and community health advocates have supported the city in favor of the tax, arguing that soda and other sugar sweetened drinks are a major driver of obesity and diabetes rates and disproportionately impact minority and low-income communities and that similar taxes enacted in other cities have helped reduce soda consumption. Supporters include Southeast Seattle-based social and climate justice group Got Green, the Save the Children Action Network, the Seattle Healthy Kids Coalition (which is chaired by medical and administrative staff from El Centro De La Raz), and physicians and economists.
Pro-tax speakers who testified on Wednesday cited successfully implemented soda taxes in Berkeley, California, and Mexico; studies have shown that the Berkeley soda taxwhich was enacted back in 2014cut soda consumption, lining up with similar results from a nationwide soda tax in Mexico (which also passed in 2014).
As an economist, I can say with confidence that these sugary drink taxes do work. They effectively change peoples behavior and this something weve seen in cities across the U.S. and in Mexico where diabetes is a public health epidemic that is driven in part by sugar drinks, said Melissa Knox, an economics professor at the University of Washington. The sugary drink tax that weve seen in Berkeley for example, it helps producers and consumers internalize the true costs of drinking sugary drinks at the time of consumption rather than let the soda industry to just defer those costs onto consumers and society at a future date.

A trial is underway for the parents of a seven-month-old baby who died after the couple self-diagnosed him with multiple food allergies, and insisted on feeding him only gluten-free and lactose-free foods, including quinoa milk.

It went on to state, family friends said, "despite the baby gasping for air in the days leading to his death, the parents never thought to seek medical attention."
Doctor's have told the parents who run a natural food store in their hometown, their son's diet was not suitable for a baby, the report said.
The attorney for the mother and father said Lucas, had an eating problem and that's the reason they tried out alternative supplements. The Daily Mail also reported, they fed their baby oat milk, rice milk, buckwheat milk, semolina milk and quinoa milk. "All products which they also sell in their store."
The parents now face 18-month jail sentences each. Prosecutors believe the baby's gluten-free diet, contributed to his death from dehydration and undernourishment, according to the report. "Even though Lucas lost a lot of weight and family friends said the boy looked dismal and was gasping for air, they never sought medical attention," prosecutors said.
Child Doctor, Elisabeth De Greef from the University Hospital of Brussels, said feeding a baby these kinds of milk is no-go, "they do not contain the necessary proteins, minerals, and vitamins."
The parents defended themselves in court, the father said, "we never went with Lucas to a doctor because we never noticed anything unusual and the mother said: "We never wished for the death of our son."
A Judge is set to make a ruling on June 14, 2017.

Planet Fitness isn’t violating privacy by welcoming transgender members, Michigan court rules – ThinkProgress

Two years ago, a Michigan woman by the name of Yvette Cormier made national news when she objected to the transgender-inclusive policies at her local Planet Fitness after she encountered a transgender woman in the locker room. She incessantly warned other women at the gym about the policy, which prompted Planet Fitness to revoke her membership. Cormier sued, and the Michigan Appeals Court has now rejected her claims outright.
In a decision issued last week, the Michigan Appeals Court ruled 30 that Cormier had no claim against the Planet Fitness for either its policy or its decision to cancel her membership. She argued that she had been subjected to sexual harassment, invasion of privacy, and breach of contract, but the panel agreed with a lower courts ruling dismissing her complaint.
In regards to her claim of sexual harassment, the Court found that Cormier made conclusory statements that she was subjected to conduct and communication of a sexual nature, but in reality, she failed to plead factual allegations showing that she was actually subjected to verbal or physical conduct or communication of a sexual nature (i.e., that her rights were violated). She saw a transgender woman in the locker room, but the woman (who is unfortunately referred to as a transgender man in the written decision) didnt do anything to Cormier that would actually be considered a violation. Indeed, they were both clothed when the interaction Cormier objected to took place.
Likewise, Cormiers claim that her privacy was violated fell flat. She has simply not alleged an intrusion of that privacy, the Court found. Even if another guest had improperly spied on her changing or showeringwhich she didnt allegeher claim would be against that individual, not Planet Fitness itself. Furthermore, she continued to use the facilities for some time after learning of the gyms policies respecting and affirming transgender members. Even though plaintiff did not agree with the policy, her use of the locker room after her knowledge of the policy constituted consent to any intrusion, defeating her claim of invasion of privacy.
Perhaps most noteworthy was the Courts disinterest in Cormiers claims that she had suffered emotional distress because she had shared a space with a transgender woman. Transgender rights and policies are polarizing issues and each individual may have a feeling on the issue and on what locker room such individuals should be using, the Court wrote. Regardless of whether an average member of the community may find the policy outrageous, the fact is that plaintiff did not suffer severe emotional distress as a matter of law.
Cormier could still appeal to the Michigan Supreme Court. She is represented by the Kallman Legal Group, which has a reputation for taking up anti-LGBTQ cases. In 2013, the firm objected to a local township implementing LGBTQ nondiscrimination protections by comparing homosexuality to extramarital sex, polygamy, pedophilia, serial killer rapists, necrophilia, bestiality, and incest and claiming that only a mind-reader could determine whether a person is transgender to avoid discriminating against them.

There was a time when travelers were lucky to get a windowless room with a few weights and cardio machines in a hotel basement. Hotels upped their game when they realized how popular yoga had become and started offering rooftop yoga classes and stocking guestrooms with mats.
Hotels are getting more elaborate with their in-room workout gear and fitness center offerings. Many tap into fitness crazes that have cult followings.
Guests at Westin Hotels & Resorts, part of Marriott International, will be able to request a WestinWORKOUT Peloton guest room. The popular indoor exercise bikes have online streaming classes.
The 1 Hotel South Beach offers classes from SoulCycle, the spinning class sensation. The Row NYC hotel has an indoor cycling studio called Cyc Fitness, a beat-based 45-minute ride.
The James has a complimentary in-room, on demand streaming workout series called ReinventYOU by ChaiseFitness, a New York City boutique fitness brand. Guests at locations in New York and Chicago can try 20-minute workouts that aim to strengthen and improve posture.
At the Star, which is anchored by Dallas Cowboys World Headquarters, the Omni Frisco Hotel will offer a Cowboys Fit Package upon the propertys opening in July. The package will allow guests to train at Cowboys Fit, where the Dallas Cowboy Cheerleaders practice.
InterContinental Hotels Group created an entire brand focused on fitness and wellness. EVEN Hotels debuted in 2014, featuring fitness equipment in each guestroom, workout videos and a large gym in a prominent spot in each property.
Hoteliers say they can no longer offer guests standard fitness amenities. Travelers are exposed to a variety of sophisticated fitness options when they are home and expect the same on the road.
In addressing the evolving fitness needs of hotel guests, brands are offering three different brand standards or amenity options at their affiliated hotels, says Chekitan Dev, an associate professor at Cornell Universitys School of Hotel Administration.

That includes updating fitness centers to include new equipment, offering in-room fitness options or providing their guests complimentary or low cost access to adjacent or nearby fitness centers.
For good reason. Globally, travelers say they have trouble maintaining their wellness routine on the road, according to a survey of about 8,000 travelers ages 25 to 64, conducted by STUDYLOGIC last year.
In fact, 65percent said they exercise less on the road. But 83 percent said access to wellness programs while traveling is at least somewhat important when choosing a hotel.

In particular, Millennials, those in their 20s and 30s who are starting to travel more, said they intend to exercise on the road. Nearly 40 percent of them specifically planned to cycle.
Peloton and SoulCycle are especially popular among younger travelers.
In Westins case, the Peloton guest rooms are available at select locations, including Chicago, Dallas, Houston, Kansas City, Los Angeles and Boston. Guests will have access to 5,000 on-demand classes taught by instructors.
At other destinations including Austin, Detroit, Denver, New York City, Palo Alto, Philadelphia, San Francisco, San Diego and Seattle the Peloton bikes will be available in fitness studios.
While global wellness trends show a growing demand for tribe workouts, travel can often be solitary, says Brian Povinelli, senior vice president and global brand leader at Westin. Pelotons social experience is perfect for Westin guests who are energized by an immersive, group-fitness experience, whether in the brands signature fitness studio or in the privacy of their own room.
The 4-year-old Peloton recently introduced bikes better suited for public areas such as hotel gyms and college campuses.
We created Peloton to allow people to get access to boutique fitness classes on their own time, on their own schedule, says John Foley, CEO and founder of Peloton. Now, were excited to bring that experience to travelers as well. Our riders can now experience the workout they already love while on the road.
Offering exclusive fitness classes with personal trainers has become a big push from hotels. The Park Hyatt Chicago will offer Shred at the Park beginning June 7, partnering with Shred415. The workout class will take place in NoMI Garden, the hotels outdoor terrace. The class will combine strength and cardio exercises to raise the heart rate and drop it down in intervals for a 45-minute workout with views of Chicagos Magnificent Mile.
Upon check-in at Element Hotels, guests get a training card that includes a three-digit code. This code lets them set up a Your Trainer profile from any iOS or Android device three workouts ranging from 10 to 12 minutes during their stay.
The Kimpton Marlowe in Cambridge, Mass., has partnered with a local organization called Community Rowing to offer an outdoor interactive row studio. Guests can row in the hotels courtyard on Concept 2 rowing machines with feedback provided by a community rowing coach. They can also compete with elite rowers who are broadcast on the hotels interior faade.
And in another twist to the fitness hospitality trend, some fitness facilities create their own hotels.
In April,Midtown Athletics Clubs announced the construction of Midtown Athletic Club and the Hotel at Midtown in Chicago. The club, constructed in 1970 as an indoor tennis club, will get additions and renovations. The 55-room hotel will include four suites, including one designed by tennis star Venus Williams and her interior design firm, V STARR Interiors. Its scheduled to re-open in July.
Williams, who used to play at the club as a junior tennis star, will design the clubs Tennis Lounge.
Its game-changing when a hotel is considered an amenity to a fitness facility, says Dwayne MacEwen, founder and principal of DMAC Architecture, which is designing the $75 million project slated for complication in July.
The high-end gym company Equinox plans to launch its own hotel brand. The first hotel will open in New York Citys Hudson Yards next year. A second one will follow in Los Angeles.
Fitness center brands are opening hotels for those guests that want to pick a fitness facility as a first priority with a room for the night to go with it, Cornells Dev says.

Apple has just announced that watchOS 4, the next version of its smartwatch platform, will be arriving later this fall. It includes new features for watchfaces, such as complications updating based on time of day or location, and a new Siri-based watchface. The Siri watchface uses machine learning to determine what information is most useful to you at a given point in time. That information can include flight boarding passes, time of sunset, or smarthome control.
In addition, Apple has developed a kaleidoscope watchface and new character faces to join the Mickey and Minnie Mouse options already available. The new characters include Woody, Jesse, and Buzz from the Toy Story movie franchise.
WatchOS 4 will also bring updates to the watchs fitness tracking, including a new user interface for the workout app and new integrations with gym equipment manufacturers. This integration will provide information such as incline and intensity to the watch for more accurate workout tracking. Apple says Watch wearers will be able to link their devices with the gym equipment through NFC.
Music management is also improved for watchOS 4; the watch will automatically import Apple Music playlists and can support multiple playlists. Apple has also redesigned the dock with a vertical interface for scrolling through recent apps.
Overall, the updates that Apple has shown off so far are not nearly as dramatic of a change as watchOS 3 was, but will pinpoint specific areas to improve the user experience. Developers will be able to access a preview version of watchOS 4 starting today, while a pubic release will be available this fall.

Fitbit fell to the third place among makers of "smart" wearables for the first time in the first quarter, according to market tracker International Data Corp. Chinese gadget maker Xiaomi tied with Apple to ship the most wearables in the quarter, IDC said.
Fitbit, which first hit the market in 2009, has long led they category with its popular line of wrist worn fitness trackers. But after years of rapid growth, the company stumbled in 2016 with manufacturing mistakes, unexciting upgrades and a collapse in demand from Chinese consumers. The company's stock price has dropped 63% over the past year amid the struggles. Still, Fitbit is expected to announce its first true smartwatch latest his year, which could reignite interest.
"Fitbit finds itself in the midst of a transformation as user tastes evolve from fitness bands to watches and other products," Ramon Llamas, research manager for wearables at IDC, said in the report released on Monday. Llamas continued:
However, by no means should Fitbit be removed from the wearables conversation. With a user base of 50 million, a strong presence within corporate wellness, and assets that keep it top of mind for digital health, Fitbit is well positioned to move into new segments and markets.
The lower end of the market, consisting of less expensive devices with fewer functions, was the most challenged in the quarter, hitting Fitbit. The company ( fit ) shipped only 3 million devices in the first quarter, a 38% drop from the same period a year ago, IDC said. Xiaomi, which aims at the low cost end of the market, saw its shipments drop 3% to 3.6 million.

But it was Apple's higher-end smartwatch, Apple Watch, along with Samsung's Gear S3 watch, that drove the overall market higher, IDC said. Apple shipped 3.6 million watches, up 64% from last year, while Samsung's shipments rose 91% to 1.4 million. The success of Apple Watch, which runs Apple's proprietary WatchOS software, and the Gear S3, which runs Samsung's Tizen software, isn't good news Google's ( googl ) Android Wear operating system. None of the five largest shippers of wearables used its program.
Samsung ranked fourth overall, followed by Garmin ( grmn ) in fifth place, with a 2% increase to 1.1 million devices shopped.
In total, the wearables markets expanded by 18% to 24.7 million devices, IDC said.
Despite the growth and volatility in the rankings, IDC analysts said the market was still just a fraction of the size it would ultimately become. Companies are still trying just to entice consumers to get accustomed to wearing a smart device, senior research analyst Jitesh Ubrani said.
"The second phase of development will be all about putting user data to good use," Ubrani said in the report. "This is when step counts translate into healthier hearts and minds. And it's also when we will start to see devices that actually augment our abilities and make our lives easier or more productive rather than just being another screen we keep an eye on."
Apple ( aapl ) may start to move in that direction on Monday. The company is holding its annual World Wide Developer Conference and is expected to unveil an update too its smartwatch software, among many other announcements.

Feeling fat? Of course you are. Whether youre one of the 69 percent of overweight Americans, or you just dont have the body youve seen on TV, almost nobody looks in the mirror in the morning and thinks, This is exactly what I want to be looking at. But that can change! Or, at least, thats the pitch that has fueled the business of countless fitness magazines for decades.
Womens Health is an eating disorder with ads. Alexandra Daddario, star of the new Baywatch reboot, graces the cover and gives a practically content-free interview. Even less surprisingly, the 31-year-old poses in different swimsuits that can be shilled to the readers.
Whats worse is that the Rodale publication lards its pages with ads for beer, cheese snacks, chips, and hard seltzer in between its few and scattered diet and exercise tips. A page with a 15-minute workout routine which uses the new Wonder Woman movie as a hook, of course is directly across from a Geico ad that uses macaron cookies to make a point about insurance.
When there are actual articles, they are indistinguishable from the fat- and sugar-strewn ads: Theres even a whole page dedicated to weight loss foods at Taco Bell, Chick-Fil-A, Wendys, and McDonalds. This mag is not only a waste of time, its a step backwards.
The cover of Mens Fitness features Ryan Phillippe, currently the star of Shooter as well as a bunch of 90s horror flicks, in addition to being the ex of Reese Witherspoon. Ostensibly, the piece is about his beach workout routine, but really hes just here to hawk a new app for middle-age gym rats. (Hes 42).
Comparing a mens fitness magazine to a womens is always going to be unfair in one aspect or another, but guess what? Mens Fitness also has an interview with Alexandra Daddario! Its even worse than the one in Womens Health. The interviewer laments how he had to conduct it over the phone, and it starts off talking about her boobs in True Detective. It ends with her talking about how low-key she is. Turns out her father is the head of counterterrorism for the NYPD, which is kind of interesting.
That aside, this mag does slightly better than its female-focused counterpart. The Geico ad in this one uses apples, not sweets. Others, though, shill protein bars and high-calorie alcohol. On the positive side, Shawn Perine, the mags editorial director, is trying to change the direction of MF to shorter, more modest goals that most people can actually achieve. There are also good, counter-intuitive pieces about how reducing salt helps people sleep better, and how sitting may be worse for your knees than running.
Times cover story The Good Son about Jared Kushner turns out to be nearly as blank as the soft-spoken presidential senior advisers look.
A description of Kushners White House office, which abuts the presidential dining room, as feeling like a waiting room, with bare white walls, save a television, a white-board and a gold-rimmed mirror, seems to confirm that the 36-year-old Kushner isnt inclined to reveal much. Yet Time gives us little more than a review of his already well-known past.
What Time does better is raise timely topics in shorter articles.
Former Secretary of State John Kerry writes an op-ed in which he says, Technology not trade is the primary reason the US lost 85 percent of its 5.6 million manufacturing jobs in the first decade of this century.
Impressive numbers, though Kerry doesnt prove his case.
A profile of Afghan leader Ashraf Ghani is timely considering he is asking President Trump directly for the US to maintain its presence in his country.
By contrast, the Atlantic engages in some topics that seem kind of unimportant.
Drag queen RuPaul gets political. Do we really care about RuPauls opinion enough for a four-page profile?
Journalist Graeme Wood writes a nine-page essay about his relationship with North Dallas high school classmate and white supremacist leader Richard Spencer.
Should the Atlantic be giving a white supremacist this much publicity?
The personal story that Pulitzer Prize-winning reporter Alex Tizon, who died in his sleep unexpectedly in March, shared about how his family essentially held a poor woman from the Philippines as a slave for 56 years is revealing.
We especially liked a convincing feature on how the once-revolutionary Pixar has lost its way since Disney bought it in 2006. Ironically, Disney Animation Studios is now scoring more accolades than Pixar, which is about to release Cars 3 and Toy Story 4.

As the nations left-leaning citizens pray for 84-year-old Justice Ruth Bader Ginsburgs good health with some begging her to eat more kale and even offering up their blood for use at her disposal in the hope of the two-time cancer survivor outlasting Donald Trumps presidency, the Norotious R.B.G. has some good news for her judicial groupies.
Come the first week of October Term 2017, like exercise gurus of the past, the liberal justice will be the star of her very own fitness book.
Written by her longtime trainer Bryant Johnson and illustrated by Patrick Welsh, the 112-page book will detail Justice Ginsburgs complete workout routine, with easy, how-to instructions. The Associated Press has some details on how the Supreme Court justice started her workout regimen:
Johnson, an Army reservist whose day job is as a court clerk in Washington, has been training Ginsburg since 1999 following her treatment for colorectal cancer. Ginsburg has said husband told her she looked like a survivor of a concentration camp and needed to do something to rebuild her strength.
These days she trains with Johnson twice a week for an hour each time, doing exercises including push-ups and the core-strengthening plank. She does two sets of 10 push-ups, and not the easier ones where the knees touch the ground.
Nothing in the world will make you feel better about yourself than the knowledge that an octogenarian is able to do more push-ups than you. In fact, Justice Ginsburgs workout is so difficult that it nearly broke Politico reporter Ben Schreckinger during his training session with Johnson.
