Why David Beckham is suing Mark Wahlberg’s fitness company – Fortune
David Beckham is taking on Mark Wahlbergbut not on the soccer pitch.
The soccer icon is suing F45 Training, a fitness company co-owned by the actor, claiming it owes him millions of dollars for an endorsement deal.
According to court filings, Beckham entered a five-year agreement in 2020 to be a brand ambassador for F45. The company said it would pay Beckham $1.5 million per year, the filings said, in addition to shares of the company six months and 12 months after it went public.
In court filings, Beckhams management business said F45 did not pay him the promised substantial cash and equity compensation for his endorsement, even after its IPO in July 2021. It claims F45 failed to make good on the following promises: to transfer nearly 1 million shares to Beckham within the time period outlined, and to issue $5 million worth of additional shares.
Beckham claimed he received the initial shares eight months later than promisedby then, F45s stock had declined, costing him $9.3 million, he said. The Inter Miami co-owner sued the fitness chain in May 2023, claiming he is entitled to more than $14 million in damages.
F45 initially sought to have the lawsuit dismissed, but a judge denied the motion in September 2023, according to Fox Business. Lawyers for F45 denied Beckhams allegations in court filings. The company said the former soccer player did not fulfill his contractual obligations and had unclean hands.
On F45s social media accounts, its business as usual. The company is currently promoting Wahlberg Week, a free-trial week of workouts created exclusively with the Ted star.
F45 first launched in Australia in 2011, and has since expanded internationally to more than 60 countries, according to its website. F45which stands for functional exercise for 45 minutescombines elements of HIIT, circuit training, and functional training.
Wahlberg acquired a 36% stake in F45 in 2019 through his investment group, according to Beckhams lawsuit, and joined the companys board the same year. The actor was named F45s chief brand officer in 2023, and regularly appears as the face of the brand in promotional materials.
But F45s valuation tumbled just as quickly: It went public on the New York Stock Exchange in July 2021 with a $1.4 billion valuation, but then a series of issues, which Beckham calls fiscal mismanagement and macroeconomic pressures, followedand the company later revealed that it lost a combined $372 million in 2021 and 2022.
F45 delisted from the stock exchange in August 2023, after it failed to file its 2022 financials with the Securities and Exchange Commission in time, thereby not complying with NYSE rules. F45s share price declined by more than 90% in 2023.
Beckham is not the only former brand ambassador to accuse F45 of not following through on payments.
Beckham initially sued F45 in October 2022 alongside former world No. 1 golfer Greg Norman, alleging breach of contract. They were later ordered by a judge to bring their cases separately, and Norman did not pursue another lawsuit.
In 2017, prior to Wahlbergs involvement with F45, former NFL wide receiver Terrell Owens was the first pro athlete to bring a lawsuit against the fitness company, claiming it owed him $700,000.
Owenss lawsuit claims he agreed to appear in a promotional video for $15,000and received the payment. But Owens also claimed that F45 promised to pay him an additional $25,000 per gym for the first 25 gyms opened, and an additional $5,000 for every opening that followed.
F45 publicly denied the claims and said it would countersue Owens, but as of April 2024, it is unclear what became of Owenss lawsuit.
Were not a company that doesnt pay our bills, F45s co-CEO told TMZ at the time.

SETS Brings Successful New Jersey Fitness Concept To New Tampa – New Tampa Neighborhood News
SETS New Tampa Hybrid Training owner Phil Diaz (right) will be working with his clients at his new fitness facility, which is expected to celebrate its Grand Opening in the Pebble Creek Collection on Bruce B. Downs Blvd. in New Tampa on Saturday, April 27. (Photos by Charmaine George)
The only Florida location of SETS Hybrid Training gyms is set to open and host fitness classes by the end of this month.
Located in the Pebble Creek Collection, less than two miles south of the Pasco/Hillsborough county line on Bruce B. Downs (BBD) Blvd.), SETS New Tampa is bringing a successful New Jersey-based fitness concept to New Tampa.
Owner and New Jersey native Phil Diaz has worked with SETS for the last four years. Phil believes in the concept so much that he left everything behind in his home state to introduce SETS to Florida.
SETS currently has 12 locations, including three corporate locations in Jersey. All of the other locations are franchises, including seven in the Garden State, one in Murfreesboro, TN, and the new one in New Tampa.
Its a growing company that has only been around since about 2015, says Diaz. Its super successful.
He says that with a caveat, though. SETS isnt growing quite as fast as some other franchises and he says thats because all franchise owners also are required to be on-site managers.
That means owners, including Phil, have to be in the gym ensuring that members get what they need, and the facility is more than just a moneymaker for some off-site investor.
That fits with the SETS philosophy, which emphasizes relationships among those who work out together.
The biggest thing we do that is different is that were very big into community, says Phil.
Thats why SETS New Tampa will be hosting a happy hour every month for members, an annual Christmas party and organize teams to participate in local events, such as Spartan (obstacle course)races.
Its super competitive, Phil says of SETS and its members, but its fun as well. Its more than just working out.
The community is bigger than just the gym members, too. Phil says public servants, such as those who work for fire and police departments, in health care, education, and active duty and military veterans receive discounts on membership.
Of his decision to move to our area, Phil says, It was the greatest decision of my life. I love this place. Its amazing.
In scoping out Florida locations to grow SETS, he considered many options, including Clearwater and St. Petersburg.
New Tampa was the choice because we fell in love, he says. Looking at the demographics, we see the growth in this area and love how everything in (nearby) Wesley Chapel is new.
While he recognizes the New Tampa location isnt convenient for many Wesley Chapel residents, he hopes to open a total of three locations in the first three years hes here, so people in our reading area who dont feel they live close enough to the New Tampa SETS may end up with a location closer to them in the near future.
SETS offers its group fitness classes several times a day. Each class is completely different, so youll never be bored. Free weights and machines are used in the group fitness setting.
Many people get intimidated because they think its just for a certain type of athlete or for fitness gurus, Phil explains. But, were literally for everyone. Some of our members are college athletes, othersjust got out of surgery or are in their 60s and havent been in a gym before.
To be able to accommodate people at every level, Phil and other coaches are always happy to demonstrate modifications for every exercise or movement. Theres always an advanced way for serious athletes to perform each exercise, Phil says, and a safer way for beginners and those who are rehabbing an injury.
Some people always get nervous trying it out, Phil explains of SETS, but I want them to feel relief because we are always happy to scale it down so they can feel comfortable.
Once you join SETS, classes are booked through the SETSBuilt app. Each class lasts 50-55 minutes, and Phil promises that the sessions sell themselves.
Every day is totally different, he explains. We change the movement up so its never the same. It could be leg day, full body day, or chest day, but its always a good mix of strength and cardio.
SETS New Tampa offers a number of different types of memberships, but Phil says most members choose the unlimited classes option. He says the majority of members will take three to five classes each week, while some work out every day and others only take one or two classes a week.
You come whenever youre available, Phil says. All you have to do is go on the app and save yourself a spot.
Phil wants you to come in and try it out, so he offers specials for those who just want to give it a try. Give him a call or stop in at the location to learn more about free trial classes.
One major perk of SETS New Tampa is that there are no long-term contracts. Each membership is paid on a monthly basis and only a 30-day notice is required if you decide you need to cancel.
The SETS New Tampa Grand Opening will be held on Saturday, April 27,featuring a number of vendors, classes and a ribbon cutting ceremony.
Since it hadnt opened yet when this issue went to press, no members of the New Tampa SETS were ready to tell us about their experience yet. However, there are SETS members in New Jersey who miss Phil and hope that people in the New Tampa/Wesley Chapel area will take advantage of the opportunity to join SETS and work out with him.
Brianna Schoeneberg is a SETS member in Barnegat, NJ. She says she first met Phil a couple years ago when he started working at the SETS gym where she trains.
Ive been working out for about 10 years now, she says, and hes been one of the best. The energy is always high and any type of modification you need, he has it. And hes literally one of the friendliest guys ever.
Brianna says that when she travels, she visits lots of different gyms but she always prefers to come back to her home gym.
Its more about community and your personal goals, Brianna says. Every coach is positive and high energy, and the classes are never the same.
Brianna says she loves the hybrid training format and that it works for all fitness levels. Club members are a strong community, but include a wide variety of ages and abilities.
Brianna thinks Phil will be able to bring the same positivity, energy, and focus on community to SETS New Tampa.
Everyone here loved him but were super happy for him on the journeys hes taking, Brianna says. Its a big thing to move from Jersey to Florida to start something new, but its pretty cool that hes taking it to Tampa. I feel like everyone there is lucky to have him, because we miss him here in Jersey.
Phil is excited to be able to offer pre-opening members of SETS New Tampa a Founders Rate of just $129 per month for unlimited classes, with no enrollment fee, and free classes until the end of April.
He notes that the Founders Rate is for unlimited classes, although SETS New Tampa also does offer other membership levels for those who dont necessarily want or need unlimited sessions.
SETS New Tampa Hybrid Training is located at 19651 Bruce B. Downs Blvd., Suite E-6, in the Pebble Creek Collection. For more information, visit SETSBuilt.com, @sets_newtampa on Instagram, SETS NEW TAMPA on Facebook.

How Fitness Franchise Brands Can Win the Global Expansion Game – Athletech News
Fitness franchises should be operating as if they want to expand globally from the jump, even if they cant right away, argues Jarron Aizen, CEO of software platform Hapana
As the fitness franchise space heats up, many brands have their eyes set on expansion. Choosing the right software provider is an essential but often overlooked piece of the franchising puzzle.
Technology hasnt changed much to adapt with ongoing requirements of fitness franchising, said Jarron Aizen, CEO and Founder of Hapana, a software provider for ambitious health and wellness businesses. There is a lack of innovation across the board. This is where we feel Hapana has an advantage.
Think Globally From the Start
Aizen argues that fitness franchise brands should be operating as if they want to expand globally from the jump, even if they cant right away.
Franchises, particularly those founded in Asia-Pacific, are starting to think like a global brand from day one. This is out of necessity, Aizen said. The individual APAC markets are smaller than the U.S., so in order to grow quickly, good franchisors must be found relatively early in the journey. We think this is happening almost everywhere except for the United States.
Going global can be daunting, but Hapana removes the barriers, Aizen added. We offer a comprehensive solution designed specifically for international expansion.
Hapanas platform integrates multiple payment providers so theres no need to fret over regional preferences. It can also onboard new locations to accept payments online even in hard-to-reach countries at a speed most competitors cannot keep up with.
Pre-built shell templates make a difference for brands launching new locations in new areas as well. This saves time and resources. Hapanas multi-language member app also fosters a welcoming environment for international audiences. The platform also consolidates reporting to provide a holistic view of an entire networks global performance.
This keeps HQ in the drivers seat, Aizen said. The ability to drill down location-wide analytics based on the master franchisor, region, state, or owner is crucial to managing.
Data Reigns Supreme
At the end of the day, accurate and plentiful data is the main foundation any successful fitness brand interested in franchising needs to acquire. Brands are recognizing this, demanding it, and Hapanas stepping up to serve them.
Data is the new battleground in fitness, Aizen said. Optimizing your business and growth through data is at the forefront of most franchisees and head offices minds. They are all hungry for insights that help them optimize marketing, staffing, and member engagement. Having all data and reporting presented in a user-friendly, easily consumable way is vital to a quick-paced industry like fitness too.
Hapana accomplishes this by tracking metrics such as member attendance to build retention and engagement insights, smarter location analysis to support resource allocation, an always-on feedback loop to curate personalized marketing campaigns and more.
New features like custom data fields make a difference as well, such as the ability to determine who is actually a gym member, gauging things like whether or not an individual has booked a class before or is just paying a recurring membership fee.
Hapanas ability to operate on multiple levels helps its franchise partners to the damel. The software provider ensures efficient and smooth distribution of its data and services across multiple channels at once. Scalability is a strong secondary benefit alongside cutting-edge data.
Scalability is ingrained in our system, ensuring smooth integration with new locations and maintaining brand consistency across the franchise network, Aizen said. But the real key is data. Our robust reporting tools provide actionable insights for data-driven decision-making.
New Innovations Make a Difference
As gamification becomes more and more popular in fitness, Hapana also just launched a Challenges feature within its app. This program sets up group tasks for individuals at participating studios or gyms. Operators select goals or levels for members to try and reach, tracking their progress along the way to spur retention. Users are also encouraged to share their achievements on social media to drive engagement as well.
The Challenges feature assists franchise brands and individual unit owners alike.
Franchisors love the challenge features flexibility to create network-wide events or targeted studio challenges, with the ability to generate new revenue with paid entry options, Aizen said. These also provide considerable marketing opportunities that generate more revenue.
For franchisees, its also a competitive edge, setting their brand apart with unique challenges that boost member engagement and social interaction, all while keeping members motivated and coming back for more, Aizen added. Its a win-win for everyone involved.
Hapana is committed to dishing out more win-win opportunities in the future. The brand is currently updating its membership software to allow franchise HQs more control and access to detailed data.
Once released we believe this will be industry-leading and incredibly sought after by franchises, Aizen said.

KL JBPM holds fitness, health programme for overweight personnel – theSun
KUALA LUMPUR: The Kuala Lumpur Fire and Rescue Department (JBPM) has initiated a fitness and health programme starting this month to ensure that all its personnel on duty maintain a normal body weight and body mass index (BMI).
Kuala Lumpur JBPM deputy director, Rozihan Anwar Mamat said that based on screenings conducted last January, about seven per cent of its 923 personnel were found to be overweight, with BMI readings exceeding 30.
He explained that although these figures are relatively low compared to personnel in other states, they will not remain complacent and aim for all on-duty personnel to meet the prescribed weight and BMI standards.
He stressed that this is to ensure that all personnel are capable of performing rescue and firefighting duties effectively without endangering themselves.
This programme has been planned since last January and has been attended by 100 personnel, with cooperation from the Cheras District Health Office and Dietmonsta Sdn Bhd, a health food supplier company.
This programme aims to ensure that personnel with BMI readings exceeding the set standards can effectively and regularly reduce their weight without compromising their health, he told Bernama at the event here today.
Commenting further, Rozihan Anwar said that the BMI readings set for all JBPM personnel on duty range from 19 to 26.
Moreover, a recent permanent directive from the director-general for the year 2024 has been issued, stipulating that any personnel who fails to meet the prescribed BMI level will face disciplinary action and will not be considered for promotion or awards, he added.

The Wellness Routine Taylor Swift Swears By – The Everygirl
Life on tour is grueling (or so Ive heard), but Taylor Swift couldve fooled us with her seemingly effortless stamina throughout her 3-hour The Eras Tour show (complete with seamless outfit changes on stage, might I add). It got me wondering how she performs her way through 44 hits from her 10 studio albums without so much as breaking a sweat or popping one of the sequins off her red-and-sequined-snaked Reputation look. So naturally, I scoured the internet for every tidbit I could find about her wellness routine.
How does she sweat it out? What does she eat in a day? Is she just like us when it comes to self-care? Thanks to various sources including Swifts interview as TIMEs 2023 Person of the Year and her trainers April 2024 interview with Vogue, we have some insight into how she prepped for the demands of her tour. Read on for a breakdown of T-Swifts health and wellness standbys. Alexa, play The Tortured Poets Department.
Confessing that she used to tour like a frat guy when she was younger, Swift didnt mess around this time. I knew this tour was harder than anything Id ever done before by a long shot, she admitted to Time. I finally, for the very first time, physically prepared correctly. Her trainer Kirk Myers, who prepared her for The Eras Tour, told Vogue that they approached her training with the mindset of a professional athlete where she has off-season and on-season. (Perhaps she got some inspo from Travis Kelce?)
When shes not on tour (or her off-season), Swift works out up to six days a week for sometimes two hours a day to prepare for the grueling tour. Six months before the first show, Swift hit the ground (or the treadmill) running. Every day I would run on the treadmill, singing the entire set list out loud, she shared with Time. Fast for fast songs, and a jog or a fast walk for slow songs. So basically she was doing her own version of the Taylor Swift treadmill workout.
In addition to training her body for the tour, she also had to train her dance moves. For that, she enlisted the help of choreographer Mandy Moore and trained for three months before the first show. I had three months of dance training because I wanted to get it in my bones, Swift said. I wanted to be so over-rehearsed that I could be silly with the fans, and not lose my train of thought. When shes on tour (or her in-season), each show was a three-hour grueling workout in itself, so she limited additional workouts to two times a week with a focus on conditioning. Taylor trained during the entire tour, Meyers said. In-season training was more about maintenance, and so it was more likestability, mobility, biomechanics.
I wanted to be so over-rehearsed that I could be silly with the fans, and not lose my train of thought.
Non-stop, back-to-back shows call for some major R&R, and Swift does it right. In between tour legs, she spends 24 hours resting and recharging. I do not leave my bed except to get food and take it back to my bed and eat it there, she explained to Time. Its a dream scenario. I can barely speak because Ive been singing for three shows straight. Swift knows the importance of carving out time to do nothing. Shes got millions of Swifties depending on her, after all. I know Im going on that stage whether Im sick, injured, heartbroken, uncomfortable, or stressed, she expressed. Although we may not take the stage and have adoring fans, we all deserve respite, whether from workouts or the daily grind. Take a breatherbe it a day in bed like Taylor, a walk around the block, or DIY-ing a lymphatic massage.
Show biz is not without its fad diets, cleanses, and quick fixes, but dont count Swift as part of that crowd. She takes a balanced approach to her diet. The only info my extensive research found on her diet was from 2010 (thats Fearless era, yall), but I think its still good advice:I try to keep it lighter, but its nothing too regimented or crazy, Swift told WebMD in 2010. I dont like to create too many rules where I dont need them. We know whats good for us, thanks to common sense. If youre a Swiftie, you already know she has a sweet tooth. I bake pumpkin bread for everyone I know and make ginger molasses cookies and hot chocolate and chai, she told Bon Apptit in 2012 (more importantly known as the Red era). As for her go-to drinks? Skinny vanilla lattes on weekdays and PSLs on weekends. The point is Im never cutting out what I love, Swift informed WebMD.
One exception to her balance-first and no-restriction mentality: Swift cut out alcohol in preparation for The Eras Tour. I was really disciplined about drinking, she told Time. I stopped drinking for a couple of months before the show except for on Grammy night. Doing that show with a hangoverI dont want to know that world. (P.S. If you dont want to cut alcohol completely like Swift, try these simple alternatives).
From interviews in 2010 to her most recent in 2023, it seems Swift has always turned to writing and creating art as key mental health practices. From a young age, any time I would feel pain I would think, Its OK, I can write about this after school,' Swift said in 2010. As a young kid, I learned to process my emotions by writing. Swift was onto something; putting pen to paper has benefits like reducing stress, creating space from negative thoughts, and deepening self-discovery.
Swift takes to her songwriting and music to process her feels: Anytime something hurts, like rejection or sadness or loneliness, or I feel joy or I fall in love, I ask myself, Can I write a song about this so I know how I feel?' she continued in 2010. Even if your journal entries about your feelings dont become a platinum hit, journaling can help process emotions. Think of it like a therapy session with yourself. There is one thing Ive learned: My response to anything that happens, good or bad, is to keep making things. Keep making art, she conveyed to Time in 2023.
Another key mental health practice is to set boundaries, not stress about things that are out of control, and prioritize joy. Over the years, Ive learned I dont have the time or bandwidth to get pressed about things that dont matter, Swift voiced. Yes, if I go out to dinner, theres going to be a whole chaotic situation outside the restaurant. But I still want to go to dinner with my friends. The moral of her story? Life is short. Have adventures. Enough said.
Yes, if I go out to dinner, theres going to be a whole chaotic situation outside the restaurant. But I still want to go to dinner with my friends. Life is short. Have adventures.
In her 2010 interview with WebMD, Swift didnt sugarcoat life on tour: riding hours on a bus, giving it her all on stage, and getting less sleep can feel draining. Her key to staying balanced through it all is following a comforting routine and packing certain travel essentials. Her first order of business when settling into her hotel room is unpacking. I do it everywhere I go, Swift said. I really like the way it feels to have my clothes put away in drawers and my shoes in the closet. Swift also shared she brings candles to every destination. Even though she shared this routine back in 2010 when we were all blasting Forever & Always (not Taylors version) from our iPods, Swift is a self-care queen through and through, and we like to think shes putting in the same effort to take care of herself during her The Eras Tour today.

Taylor Swift’s Personal Trainer Shares Her Fitness Secrets to Working Out Like "Professional Athlete" – E! Online – E! NEWS
Taylor Swiftreally is the manwhen it comes to working out.
In fact, her personal trainerKirk Myers believes that "some people would probably throw up or have to lay down on the floor if they trained like her."
"It's tailored," he told Vogue in an interview published April 19. "We approached her training for the Eras Tour with the mindset like a professional athlete. There was an 'off-season' when she wasn't touring and 'in-season' when she was."
And Taylor doesn't slack off just because there's a blank space on her tour calendar. According to Kirk, the "Fortnight" singer is in the gym "up to six days a week for sometimes two hours a day" during her downtime.
"Taylor is the most resilient person I have ever met," he said. "It's super-inspiring to see her consistently overcome obstacles and become better and stronger in the end. This also translates into her training and throughout her workouts."
The Dogpound gym founder continued, "I give her a difficult exercise or challenging workout, not only is she able to complete and push through itbut she also perseveres, moving forward into the next exercise. This ultimately makes her stronger, better and faster."

Former Ohio State quarterback Cardale Jones once famously tweeted that he didn't go to Columbus to "play school," but in the years since his college days, It looks like he keeps a closer eye on current events, and he's not liking what he's seeing from President Joe Biden.
Jones hopped on X to voice his concerns about the Commander-In-Chief's well-being, particularly his mental state.
Yeah, we picked up on that too, Cardale.
Jones didn't say what specifically led him to post this. It could've been any number of Biden goofs and faux pas from over the years, but it came not long after Biden went Ron Burgundy on us and read directions off the teleprompter.
That's the latest instance of Biden's seemingly slipping mental faculties, but there are plenty of them.
From speech gaffes to trying to shake hands with ghosts, Biden's slip-ups know no bounds.
Jones has apparently seen enough to be concerned, and that's why the president's health and mental fitness is such a huge issue. This guy is making decisions with global ramifications?
Yikes.
Although, some were trying to tell poor Cardale there was nothing to see here. Keep in mind, he just watched the leader of the free world flub his way through a speech, and this is how one user responded.
We may have different definitions of "governing effectively." My definition doesn't include a border as leaky as a sieve and sitting idly by while Jewish students are chased off of campuses, but Nan's might.
That could be where the disconnect is
But it's good to see Jones taking an interest in this stuff. Within the last week, he also posted a condemnation of the anti-Israel protests breaking out at his alma mater.
"This isnt THE Ohio State University I attended," Jones wrote. "Never understood how someone or a group of people could have so much hate towards another. I hope behaviors & actions as such is addressed accordingly & allow EVERYONE to a Buckeye peaceful(ly), proudly and SAFELY. As always #GoBucks"
